1. Acceptance of Terms

By creating an account, accessing, or using the ultymate platform ("Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms that apply to specific features. If you do not agree to these Terms, do not use the Service.

2. Eligibility — You Must Be 18 or Older

Age Verification

We collect your age at registration and use it to verify you meet the 18+ minimum age requirement. We may request additional verification at any time. Providing a false age constitutes a material breach of these Terms and may expose you to legal liability. We will delete all data associated with any account found to belong to a minor.

US — COPPA Compliance

The Children's Online Privacy Protection Act (COPPA) prohibits the online collection of personal information from children under 13 without verifiable parental consent. Because ultymate processes biometric and health data, we apply a higher standard: we do not permit use by anyone under 18, and we do not knowingly collect any personal information from anyone under 18. If you are the parent or guardian of a child under 13 who has submitted personal information to ultymate, please contact us immediately at support@ultymate.co and we will delete all associated data within 72 hours.

EU & UK — GDPR Article 8 / UK Children's Code Compliance

Because ultymate processes special-category biometric and health data and its analysis of physical appearance carries psychological risk, we apply a uniform 18+ minimum globally — well above all EU/UK statutory thresholds. We do not rely on consent from anyone under 18 for any processing.

If we become aware that a user is under 18, we will immediately suspend their account, delete all associated personal data, and notify the user by email of the reason for termination.

3. Description of Service

ultymate is a wellness and personal development platform that provides:

• AI-powered facial analysis identifying aesthetic and wellness indicators
• Personalised improvement protocols based on analysis results
• Health and lifestyle recommendations
• Progress tracking tools

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised access to your account. You are responsible for all activity that occurs under your account.

You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

5. Biometric and Facial Data

ultymate's Service involves the processing of facial images and biometric identifiers. By using ultymate, you expressly consent to:

• The collection of facial images and biometric data for the purpose of providing the Service
• The processing of such data by our AI systems to generate your analysis
• The secure storage of your facial images and analysis results for the duration of your account, so you can return to view and compare your progress over time

We will never sell your biometric data to third parties. We will never use your facial images to train AI models without your separate explicit consent. You may delete any or all of your images at any time through your account settings, or by contacting support@ultymate.co.

If you are a resident of Illinois, Texas, Washington, California, or any other jurisdiction with specific biometric privacy laws, you have additional rights as described in our Privacy Policy.

6. Not Medical Advice

ultymate provides wellness information and personalised recommendations. This is not medical advice:

• ultymate does not diagnose any medical condition
• ultymate does not prescribe treatments or medications
• ultymate's identification of potential health indicators is not a clinical assessment
• Results may not be accurate and should not be relied upon for medical decisions

7. Prohibited Uses

You agree not to:

• Use the Service if you are under 18 years of age
• Upload images of other people without their explicit consent
• Use the Service to harass, harm, or demean yourself or others
• Attempt to reverse-engineer, scrape, or copy our AI models or data
• Use the Service for any unlawful purpose
• Share your account credentials with others

8. Mental Health, Body Dysmorphia & Wellbeing

Body Dysmorphic Disorder (BDD)

Appearance-focused analysis tools like ultymate are contraindicated for people with BDD. If you have been diagnosed with BDD, or believe you may have BDD, we strongly advise you not to use ultymate without first consulting a qualified mental health professional.

Our Right to Protect Vulnerable Users

ultymate reserves the right to suspend or terminate access to the Service, at our sole discretion, if we reasonably believe that continued use poses a risk to a user's psychological wellbeing.

9. Intellectual Property

ultymate owns all rights to the platform, AI models, analysis methodology, and content. You retain ownership of any images you upload. By uploading images, you grant ultymate a limited licence to process those images solely for the purpose of generating your analysis.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

11. Limitation of Liability

To the fullest extent permitted by law, ultymate Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the Service.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or prominent notice on the platform. Continued use of the Service after changes constitutes acceptance of the revised Terms.
